Welcome to Chateau Eufloria. The terms “we,” “us,” and “our” refer to Chateau Eufloria.
Chateau Eufloria operates this website and online store, including related information, content, features, products, services, and customer support (collectively, the “Services”). Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service, together with any policies or terms incorporated by reference, govern your access to and use of the Services.
Please read these Terms carefully. By accessing the Services, submitting an inquiry, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
1. Eligibility and Accounts
By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or otherwise legally permitted to use the Services.
Certain products may be subject to additional age or eligibility requirements.
If customer accounts are available, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.
You agree to provide accurate, current, and complete information when using the Services or placing an order.
2. Products and Natural Variation
We make reasonable efforts to display and describe our products accurately. However, colors and appearance may vary depending on photography, lighting, screen settings, and other factors.
Flowers, plants, and other natural materials inherently vary in color, size, shape, texture, and variety.
Product photographs are intended to represent the overall palette, scale, character, and design of an item and may not depict the exact flowers or materials received.
Because floral products are seasonal and subject to availability, we may make substitutions when reasonably necessary. Substitutions will be made with the intention of preserving the overall style, color palette, quality, character, and value of the design.
We do not guarantee that natural products will be identical to photographs or previous arrangements.
Products, pricing, descriptions, and availability may change without notice.
3. Orders and Acceptance
Submitting an order constitutes an offer to purchase.
We reserve the right to accept, reject, limit, modify, or cancel an order where permitted by law.
An order is not considered accepted until payment has been successfully processed and we have confirmed the order.
Please review your order carefully before submitting it.
Because certain products are perishable, seasonal, customized, made to order, or prepared specifically for a scheduled delivery or event, changes or cancellations may not always be possible once sourcing, preparation, or production has begun.
Purchases are also subject to our Refund Policy.
4. Pricing and Payment
Prices and promotions are subject to change without notice.
Unless otherwise stated, displayed prices do not include applicable taxes, delivery fees, shipping charges, service fees, or other charges that may apply.
You agree to provide accurate and complete payment and billing information.
You represent that you are authorized to use any payment method submitted in connection with a transaction.
5. Delivery, Pickup, and Fulfillment
Available delivery, pickup, or shipping options will be shown at checkout or otherwise communicated before an order is completed.
Delivery and pickup times are estimates unless expressly confirmed otherwise.
We will make reasonable efforts to fulfill orders within the applicable window, but delays may occur because of weather, traffic, recipient availability, building access, incorrect delivery information, carrier delays, or circumstances outside our reasonable control.
You are responsible for providing accurate recipient, address, telephone, and delivery information.
If a recipient is unavailable, we may contact the purchaser or recipient to determine an appropriate next step.
Additional charges may apply if an order must be redirected or redelivered because information supplied with the order was inaccurate or incomplete.
6. Floral Care and Perishable Products
Flowers and plants are natural and perishable products.
Their condition and lifespan may vary based on variety, season, handling, temperature, environment, water quality, and care after delivery or pickup.
We do not guarantee a specific vase life or lifespan unless expressly stated.
Customers should follow any care instructions supplied with the product or made available through the Services.
7. Custom Orders, Weddings, and Events
Custom floral work, weddings, events, commercial floral programs, personalized products, and other made-to-order services may be subject to additional proposals, estimates, invoices, retainers, payment schedules, cancellation terms, or written agreements.
Where a separate signed agreement applies, that agreement will control if it conflicts with these Terms with respect to the services covered by that agreement.
Reference photographs, Pinterest boards, color palettes, and other inspiration are used as creative guidance only.
Because flowers and botanical materials are natural and seasonal, we do not guarantee exact replication of another arrangement, photograph, or designer’s work.
Chateau Eufloria retains reasonable creative discretion in the execution of custom floral work unless otherwise agreed in writing.
8. Food and Third-Party Products
Certain food, gift, or specialty items may be prepared, manufactured, or supplied by third-party partners.
Product information, ingredients, and allergen information may be based on information supplied by those partners.
Customers with food allergies or sensitivities should review product-specific information and contact us before ordering if additional information is needed.
We cannot guarantee that food products are free from allergens or cross-contact unless expressly stated by the applicable manufacturer or food partner.
9. Vin and Alcoholic Beverages
Vin is a future Chateau Eufloria offering and alcoholic beverages are not currently available for purchase.
If and when alcoholic beverages are offered, all sales, pickup, delivery, age-verification, identification, geographic, and fulfillment requirements will be subject to applicable law and the permissions of the licenses or permits under which Chateau Eufloria operates.
Alcohol will not be knowingly sold or provided to anyone under 21 years of age.
Government-issued identification and other verification may be required where applicable.
We reserve the right to refuse or cancel an alcohol-related transaction when required by law or when applicable age, identity, licensing, or fulfillment requirements cannot be satisfied.
10. Gift Cards
Gift cards may be subject to additional terms presented at purchase.
Gift cards are not redeemable for cash except where required by law.
Lost, stolen, or improperly used gift cards may not be replaceable except as required by applicable law.
Any expiration, fee, or redemption terms will be governed by the terms presented with the applicable gift card and applicable law.
11. Intellectual Property
The Services and their original content, including the Chateau Eufloria name, branding, logos, photographs, graphics, text, videos, website design, and other original materials, are owned by or licensed to Chateau Eufloria and are protected by applicable intellectual property laws.
You may use the Services only for lawful personal use.
You may not reproduce, distribute, modify, republish, commercially exploit, or create derivative works from protected content without prior written permission, except where permitted by law.
All rights not expressly granted are reserved.
12. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, applications, tools, payment providers, social platforms, or services.
We do not control and are not responsible for third-party content, privacy practices, terms, availability, or services.
Your use of third-party services may be governed by separate terms and privacy policies.
13. Shopify
Our online store is powered by Shopify.
Transactions made through the Chateau Eufloria store are transactions between you and Chateau Eufloria.
Shopify provides ecommerce technology and related services and processes certain information as described in its own applicable terms and privacy policies.

Our collection and use of personal information is described in our Privacy Policy.
By using the Services, you acknowledge that personal information may also be processed by Shopify and other service providers necessary to operate the Services.
15. Errors and Inaccuracies
The Services may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, prices, availability, promotions, delivery information, or other content.
We reserve the right to correct information and, where permitted by law, modify or cancel affected orders.

Nothing in these Terms limits liability where such liability cannot lawfully be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Chateau Eufloria and its owners, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from your material violation of these Terms, applicable law, or the rights of another person.

Obligations incurred before termination remain enforceable.
Provisions that by their nature are intended to survive termination will continue to apply.

22. No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

These Terms and the Services are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.
Any dispute will be subject to the jurisdiction and venue available under applicable law.
